Welcome to Standard Meds. These Terms of Use ("Terms") govern your access to and use of the Standard Meds website located at https://www.standardmeds.com, the Standard Meds mobile application, and any other services, features, or content provided by NTRO Health LLC, doing business as Standard Meds (collectively, the "Platform").
Please read these Terms carefully before using our Platform. By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy (https://www.standardmeds.com/privacy), and any additional terms and conditions that may apply to specific products or services. If you do not agree to these Terms, you must not use our Platform.
1. Who We Are
Standard Meds is a science-based, people-first wellness company. We provide an online platform that connects customers with licensed healthcare providers and licensed pharmacies. Standard Meds is not a pharmacy or a healthcare provider and does not itself provide medical services, diagnosis, or prescriptions.
Medical services, including consultations and prescription fulfillment, are provided solely by third-party licensed providers and licensed pharmacies, such as our partner ChemistryRx.
2. Eligibility
You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this requirement.
3. Not Medical Advice
The information provided on the Platform is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider regarding any medical condition or treatment.
Never disregard or delay seeking professional medical advice because of something you have read on our Platform.
4. Your Account
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Standard Meds reserves the right to suspend or terminate accounts that violate these Terms.
5. User Responsibilities
You agree to not:
- Use the Platform for unlawful purposes
- Provide false or misleading information
- Interfere with Platform operations or security
- Attempt to gain unauthorized access to any part of the Platform
6. Payment and Refunds
All prices for products and services are listed in U.S. dollars unless otherwise stated. Payments are processed through third-party payment processors. Any refunds will be handled in accordance with applicable law and our refund policies, as described below or as otherwise disclosed at the time of purchase.
7. Prescription Services
If you purchase products requiring a prescription, a licensed healthcare provider will review your intake form to determine if treatment is appropriate. Prescriptions are issued solely at the discretion of the licensed provider. If approved, your prescription will be fulfilled and shipped by a licensed pharmacy.
8. HIPAA and Privacy
Some of the information you provide may be considered Protected Health Information ("PHI") under HIPAA. PHI will be collected, used, and disclosed in accordance with applicable HIPAA regulations and our Privacy Policy (https://www.standardmeds.com/privacy).
9. Intellectual Property
All content on the Platform, including text, images, logos, and designs, is the property of Standard Meds or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or modify any content without our written consent.
10. Third-Party Links and Services
The Platform may contain links to third-party websites or services. Standard Meds is not responsible for the content, policies, or practices of these third parties.
11. Disclaimers
To the fullest extent permitted by law, the Platform and all services are provided "as is" and "as available," without warranties of any kind. Standard Meds disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Standard Meds does not guarantee that the Platform will be uninterrupted, secure, error-free, or continuously available. Standard Meds may suspend, modify, or discontinue the Platform at any time for operational, technical, regulatory, or commercial reasons without liability. Standard Meds shall not be liable for any interruption, delay, suspension, or unavailability of the Platform.
12. Limitation of Liability
To the maximum extent permitted by law, Standard Meds, its affiliates, and its partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.
13. Indemnification
You agree to indemnify, defend, and hold harmless Standard Meds, its officers, directors, employees, and partners from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform or your violation of these Terms.
14. Governing Law; Arbitration; Class Action Waiver; Venue; Severability
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform (each, a “Dispute”) shall be resolved exclusively through final and binding arbitration, and not in a court of law, except as expressly provided below.
You and Standard Meds agree that both parties are waiving the right to a trial by jury or to participate in a class action.
The arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules and shall be governed by the Federal Arbitration Act ("FAA").
The arbitration shall be conducted in the State of Delaware, unless otherwise required by applicable law.
You and Standard Meds agree that any Dispute must be brought on an individual basis only, and not as a plaintiff or class member in any class, collective, representative, or consolidated action.
Notwithstanding the foregoing, either party may bring an individual claim in small claims court, if such court has jurisdiction.
If any provision of this Section is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted with an updated "Effective Date." Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
